THE GENERAL CONDITIONS FOR RENT-A BIKE
I.
Herewith are the General Conditions with which Maricom d.o.o. (hereinafter: Maricom or Landlord), rents bicycles with associated equipment - helmet, padlock and key, bell, flashlight, mini pump, bag for your mobile phone, spare inner tire and mini tool, basket, luggage carrier, bottle holder, bottle, child seats, tire iron, rubber tire patches, (hereinafter: bicycle) to people (hereinafter: Tenant or User), according to these General Conditions of use and concluded contract.
The number (amount) of bicycles for rent, prices and other important information referring to rent-a bike, will be pointed out in the office, by the Landlord.
II.
The rented bicycle can only be used for personal transport and used by the person who rented it. Giving away your right on the bicycle and the equipment or giving it in sublease to other people is not permitted.
Bicycles cannot be rented to people under the age of 16.
The contract with people under the age of 16 can only be approved by his/hers legal guardian.
The User uses the bicycle at his own risk. The responsibility starts from the moment when the bicycle is taken to when it is returned in its working condition.
The user of the above-mentioned services is obligated to pay the compensation (rent) which is determined according to the Maricoms valid price-list on the rent day.
The compensation (price) is determined depending on the number of hours or daily usage. Every overrun of the time limit for rent will be charged according to current prices.
III.
The bicycle can be taken for usage based on a concluded contract, in accordance with these General Conditions on which the User gives his consent by signing the contract.
The Landlord guarantees to the User the secrecy of personal data that is necessary to conclude the contract (VAT, address, phone number, copy of your ID-card, passports.). The information listed above (VAT, address, phone number, copy of your ID-card, passports.), will not be made available to third parties, unless on legal basis and when legal and contract rights or obligations are implemented.
The User, right before taking the bicycle is obligated to examine it and report any damage or malfunction that he spotted.
If the User, during his bicycle ride notices any malfunction, he is obligated to report it immediately and if the malfunction isn’t caused by incorrect usage he/she has the right to receive another faultless bicycle to use if the Landlord has one available.
The User is also obligated to protect the bicycle from theft and lock it while the bicycle is not being used.
IV.
In accordance with these General Conditions and the contract, the User is obligated to behave responsibly as well as to keep the bicycle safe and use it as the regulations say. Over and above, the User is strictly obligated to follow the rules and legal regulations, including the Road Traffic Safety Act.
The User is not allowed to perform any changes or modifications on the bicycle/or equipment.
The User is obligated to compensate any damage on the bicycle that was made by its incorrect usage.
The Landlord is not responsible for any personal effects that the User is carrying on the bicycle.
The Landlord is not responsible for any possible injuries of the User or third parties that were caused by bicycle usage.
V.
Furthermore the User is obligated:
- to return the bicycle in the same correct (functional) state in which it was taken and in scheduled time. In case the bicycle wasn’t returned 24 hours past the deadline, the bicycle will be considered estranged and a notification to the police will be submitted,
- not to estrange the bicycle and its associated parts,
- to compensate the value of the new bicycle in the case of theft, estrange or loss of the bicycle

Everything that is not regulated with these General Conditions and the contract, the Civil Obligations Act is to be applied.
In the case of legal disputes, the subject is matter of Pag court jurisdiction.
